Policy Related to Audio Recordings of Live Performances
Free Radicals permits audience taping at our shows, although particular
venues may not. The enjoyment of the audience in attendance at a
concert or musical performance always takes precedence over recording
efforts. This means that at no time should tapers those making the
audio recording ever ask other patrons to move, be quiet, or be
otherwise interrupted in their enjoyment of the show. If any number of
copies are made from a Free Radicals concert recording, one copy, on DAT
or CD, must be sent to Free Radicals, 8377 Westview Drive, Houston, TX
77055. Please include your contact information in case we become
interested in releasing any songs from the recording. Free Radicals
reserves the right, in all instances, to use such recordings for any
purposes and in any form of media, including, without limitation, the
right to (1) reproduce, prepare derivative works based upon, distribute
copies of, publicly perform, or publicly display the recording; (2)
trade, exchange, or share the recording; or (3) officially release the
recording -- all without any payment or accounting made to the
individual or individuals who made the recording.
All participants in audio recording exchange (regardless of format) acknowledge and
respect the copyrights and exclusive ownership of the music and
performances by the performers, writers, and publishers. All taping
must be for personal use only, which may include trading (via analog or
digital tape, CD, or digital or electronic file transfer). Recordings
may be traded only for an equivalent amount of similar media (cassettes
or CDs, pre-recorded or blank). Regardless of any expenses incurred, no
money may ever be exchanged as part of a trade; however, stamped,
self-addressed envelopes may be included with blank media. In addition,
the media by which audio trading is publicized may not be
commercialized. Therefore newsletters, web sites, clubs, or any other
communication forum facilitating audio trading cannot accept
advertising, offer links for compensation, exploit databases compiled
from their traffic, or otherwise derive any commercial proceeds in any
form. Stores or businesses may not offer to duplicate Free Radicals
media for customers or sell or otherwise provide media containing
unreleased Free Radicals music for any price. A statement of compliance
with this policy must be clearly posted on all web sites engaged in
trading activity. If we have chosen to offer for sale (via physical
media such as CD, or via digital or electronic transmission) a
particular Free Radicals performance, this "official" version will take
precedence over amateur recordings being offered for download. In these
instances, we require that digital or electronic audio repositories
remove any recording of these particular performances from their
collections within 3 days of the official release or within 3 days of
Free Radicals announcing the intention to release, whichever is earlier.
Notwithstanding the above, Free Radicals reserves the right to require
immediate removal of any unreleased Free Radicals material. It is the
responsibility of the site host to remain informed of the current list
of Free Radicals' officially-released recordings and to maintain their
site accordingly. A listing of such officially-released recordings may
be found at our web site,

In no case may any officially-released Free Radicals recording (live or
studio) be duplicated or otherwise traded or offered. Broadcast of
unreleased Free Radicals recordings via radio or online is permissible
only if it conforms to all the guidelines applicable to other forms of
duplication.
Audience taping at Free Radicals concerts is
authorized for non-commercial purposes only. Unauthorized sale,
duplication, and/or distribution is strictly forbidden. All Free
Radicals performances and recordings are the exclusive property of Free
Radicals. All rights reserved. The privilege to record Free Radicals
performances set forth in this policy constitute an express, revocable
license. We reserve the right to withdraw our sanction of recording,
tape trading, and/or non-commercial digital or electronic audio file
transfers on a case specific basis or in general, as we deem necessary.
No waiver of any copyright or trademark rights is intended.

All Free Radicals music is Released under the conditions of the following License which was created by Creative Commons
Attribution-NonCommercial-ShareAlike 2.0
You are free:
1) to copy, distribute, display, and perform the work
2) to make derivative works
